TRAINING & SERVICE AGREEMENT

Please read the following and sign below

I/We (hereinafter referred to as  “Client”) have voluntarily employed Joyce Keeton (hereinafter referred to as “Consultant”) to assist me in the training of my dog(s)

 

Professional Fees:

No Refund given. If Client cancels training for any reason, no refund will be given. Every effort will be made to accommodate changes in the dog’s situation that would require an alteration in the training sessions such as health reasons.

 

Scheduling Guidelines:
  1. Client must transport their dog to the predetermined training location for training on selected training days at predetermined times.

  2. Client must arrive on time for training days. If Client is late, said Client will forfeit the portion of the session they missed.

  3. If Client wants to schedule a make-up date/time, said Client may request a make-up session at a cost of $50

  4. Consultant reserves the right to postpone or cancel any class due to weather, illness, extenuating circumstance or Acts of God.

 

Description of Services And Client's Agreement to Terms:

Client understands that Consultant will work directly with Client and the dog(s) to impart contemporary animal behavior knowledge that best fits their needs, and that successful companion dog programs depend on a combination of learned skills on the part of the dog and owner.  Behavior is not static; an animal will not continue to perform even trained behaviors without ongoing practice.  Especially in cases involving any type of aggression, although behavior may be modified, the dog is never considered “cured”.  A dog’s behavior is ultimately the owner’s responsibility.  Consultant will make every reasonable effort to help Client and dog(s) attain goals but makes no guarantees of performance on the part of Client or dog as result of providing professional animal behavior consultations.

Client understands that it is his/her/their responsibility to set up a daily living environment for the dog(s) that encourages the dog(s) to practice appropriate behaviors and not allow the dog(s) to be placed in situations where inappropriate or dangerous behaviors can be practiced. Client understands that this may include, but not be limited to, making modifications recommended by Consultant to the home, life style and/or the way they and others interact with the dog(s), and understands that the modifications may last the life of the dog(s). Client understands that behavior change is a process that takes time, and Client commitment, that often extends beyond the length of this agreement.

Client understands and agrees that if these lessons take place in a group class setting, and that client and dog will be training in an environment with other un-trained, and potentially aggressive, dogs and clients.  At Consultant's sole election, Consultant's duties, hereunder shall terminate if (a) in Consultant's sole judgment Client's dog(s) is dangerous or vicious to Consultant or any other person or animal, or interferes with the training of other dogs, and/or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Consultant's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

All behavioral advice and training suggestions are provided at the client’s own risk. Use of this information is voluntary and Consultant, its employee(s), independent contractor(s) or agent(s) are not responsible for injury to another human or animal. The client is at all times responsible for the actions of their dog. Consultant, its employee(s), independent contractor(s) or agent(s)are not responsible for any injuries or expenses resulting from socialization or training. Dogs participating in physical exercises may be injured by running, jumping, chasing a ball etc. Client hereby agrees to indemnify and hold harmless Consultant, its employee(s), independent contractor(s) or agent(s) from any liability to Client, Client's dog(s), or to any other client or dog(s) participating in the group class.

Client acknowledges that the Consultant's Premises, or any other location deemed appropriate by Consultant, and the animals, guests, items and activities thereon, pose dangers to people and animals. Such dangers include, by way of example and not limitation, animals that can bite, trip, knock down, and fight, indoor and outdoor surfaces that may be slippery, or uneven, equipment that can trip, guests and clients who cannot control their dogs, and activities involving Client's dog(s), other dogs that can result in injury from bites or other causes.  Client, on behalf of him/her/them, his/her/their spouse/partner and minor children, and anyone else whom Client brings onto Consultant's Premises, or any other location deemed appropriate by Consultant, assumes the risk of injuries, losses, damages, costs and expenses by any means above described, and other injuries, losses, damages, costs and expenses of every possible cause and description, and agrees to hold harmless and release Consultant, its employee(s), independent contractor(s) or agent(s)for any resulting injuries, losses, damages, costs or expenses.

Client assumes the risk, should the Client's dog(s) be injured in any manner, including fight or altercation with another dog or animal, or accident, gets fleas, ticks or worms, contracts any illness or disease, be lost or stolen, become pregnant, or engage in any dangerous, vicious or unwanted behavior, during or after the term of the Agreement, on or off the Consultant's Premises, or any other location deemed appropriate by Consultant, and agrees to hold harmless and release Consultant, its employee(s), independent contractor(s) or agent(s) for any resulting injuries, losses, damages, costs or expenses.

If Client's dog(s) causes property damage, or bites or injures any dog, animal or person (including but not limited to Consultant and Consultant's agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Consultant and Consultant's agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees.

Client agrees that Consultant, her heirs, assignees and legal representatives will not make claim against, sue, or attach the property of the Consultant, their family, acquaintances, or any other person acting on their behalf (herein referred to as “Agents”), for injury or damage to or by dog(s) resulting from action or negligence, however caused, by Consultants for Agents.  Client forever releases Consultant and/or Agents from any and all liability, except for any claims of gross negligence, and demands which Client, and my heirs, assignees and legal representatives may have or may hereafter have for injury or damage to or by dog(s), and assume all risks thereof.

Consultant is not responsible for lost or misplaced dog leashes, harnesses, collars, and other personal belongings.

This Contract is governed by the laws of the State of Georgia.  Client and Consultant ("Parties") hereby agree that in the event of a dispute that may arise from or be related to any services provided by Consultant to Client and/or the terms contained herein, the Parties will submit any such disputes to a binding mediation and /or arbitration service or provider who is mutually agreed upon by the Parties.  In the event that the Parties cannot agree on a mediation/arbitration service, the Parties agree that they will use a licensed mediator/ arbitrator associated with BAY Mediation and Arbitration, located at 5775 Glenridge Dr, Suite 100, Atlanta, GA 30328. The Parties acknowledge that any such mediation/arbitration will be binding upon the Parties and that the Parties will forego any right to further legal proceedings in any court in the State of Georgia, other than as necessary to enforce the mediator's/arbitrator's decision. In any action or proceeding related to or arising out of this agreement or any services provided by Consultant pursuant to this agreement, the prevailing party shall be entitled to reimbursement of costs and legal fees.

This Contract for Training Services supersedes all other agreements, written or oral, previously made between Client and Consultants.

  • I agree to allow Joyce Keeton to video me, my dog(s), and my property.  I authorize Joyce Keeton to copyright, use, or publish these videos for educational purposes.

 

  • I agree to allow Joyce Keeton to contact my dog’s Veterinarian to discuss behavior and medical history.
